This is a wedding videography agreement proposed by Amber Wyatt for Charity Reid and Brian Davis.
This agreement is not to scare, intimidate, or leave said couple running for the hills with legal jargon. Rather, here is a written document about expectations, a safety net of sorts, to make sure I, Amber Wyatt, and you two are on the same wavelength and it's expressed in a clear manner. This contract may be added upon by the couple or the photographer/videographer, that's me again, if a request arises and is thoroughly discussed beforehand.This agreement is dated and in effect as of the August 11,2016 between Charity Reid and Brian Davis hereafter referred to as "Client" and Amber Wyatt hereafter referred to as "Consultant". This agreement is with respect to the documentation through filming of Client's wedding day in completion, hereinafter referred to as the "Work." Whereas, Consultant is a freelancing videographer of good standing; Whereas, Client wishes Consultant to create certain Work described more fully herein; and Whereas, Consultant wishes to create such Work; Now, therefore, in consideration of the foregoing premises and the mutual covenants hereinafter set forth and other valuable considerations, the parties hereto agree as follows:
DESCRIPTION OF WORK:
The consultant, that's me again, will provide to the clients, that's you two, a top notch video for a visual record of their entire day (Yes, that means messy hair before the hair dresser, emotions captured with or without mascara streaming down, oh and laughing, there will be plenty of that to go around) and a full length ceremony recording for their personal use and distribution. The entire recording of the day will be broken into cinematographic clips flowing together to represent the day in it's entirety in an artful manner, this excludes the previously agreed upon separate full length ceremony capture. If the client wishes to not have certain moments not recorded, it is the clients responsibility to make the consultant aware of this prior to the ceremony or within the moment. The consultant will provide a preview clip to the clients before the final video revision is given so that any revisions asked by the clients can be addressed by the consultant. The consultant will deliver preview files no later than seven days after the ceremony. It is the clients responsibility to respond within a reasonable time frame about approval or disapproval of editing choices so that the consultant can address said issues in a timely manner and deliver the final revision no later than two weeks after the first preview file is given.
The full length of this contract is as follows:
Client shall pay Consultant $150.00, as a deposit for project commencement once this contract is signed.
The client acknowledges that all payments must be paid in cash or check to the consultant.
The balance of $1150.00 is due in an agreed upon payment schedule discussed upon contract signing and will be added to the agreement once confirmed.
Consultant agrees to deliver samples of design on dates as agreed upon in the Proposal. Consultant will make every effort to meet agreed upon due dates. The Client should be aware that failure to submit required information or materials may cause subsequent delays in the production. Client delays could result in significant delays in delivery of finished work.
The Client may publish or disclose information regarding the Work and shall acknowledge the support of Consultant in all such publications. The Client will not use the name of Consultant, in any advertising or publicity without the prior approval from the Consultant. The Consultant will not use the name of Client, in any advertising or publicity without the prior approval from the Client.
Copyright is in Consultant's name. Upon completion of Work, the copyright will only be released to the Client upon the Consultant's payment.
Any harm caused to the consultant, physically or sexually within the work environment will immediately terminate said services. Work that is documented up until the incident will be given but it will not be consultants further responsibility to capture the remaining portion the ceremony or reception if her safety is compromised.
The Client and Consultant are independent parties and nothing in this Agreement shall constitute either party as the employer, principal or partner of or joint venture with the other party. Neither the Client nor Consultant has any authority to assume or create any obligation or liability, either express or implied, on behalf of the other.
This Agreement shall be governed by and construed in accordance with the laws of Virginia applicable therein.
